This paper is a survey of the law in the United States which is applicable to consulting scientists and engineers. Based on the body of law which has developed for the construction industry and professional “advice-givers” such as attorneys, medical doctors and accountants, the paper reviews professional responsibilities in the areas of Common Law Torts. Common Law Contracts, certain U.S. Federal and State Statutes and the protection of sensitive information.

Objective: To identify the frequency and nature of care conflict dilemmas that United States long-term care providers encounter, response strategies, and use of ethics resources to assist with dispute resolution. Design: An online cross-sectional survey was distributed to the Society for Post-Acute and Long-Term Care Medicine (AMDA). Results: Two-thirds of participants, primarily medical directors, have rejected surrogate instructions and 71% have managed family conflict. Conflict over treatment decisions and issues interpreting advance directives were frequently reported. Half of facilities lack a (...) formal dispute mediation policy. Only five respondents have called an ethics consult for assistance. Conclusion: Ethically tense care conflicts commonly arise in long-term and post-acute care facilities. Few facility procedures incorporate ethics resources into actual practice. Recommendations are made to create actionable policy, increase access to ethics services, and support staff skill development in order to improve the end-of-life care experiences for patients, families, and care facility staff. Based on metatheoretical considerations, this article discusses what kinds of traffic forecasts are possible and what kinds are impossible to make with any reasonable degree of accuracy. It will be argued on ontological and epistemological grounds that it is inherently impossible to make exact predictions about the magnitude of the ‘general’ traffic growth 20-30 years ahead, since many of the influencing factors depend on inherently unpredictable geopolitical trajectories as well as contested political decision-making. Due to the context-dependency of each particular (...) planning situation, it is also hardly possible to make exact, quantitative predictions about the impact of implementing a specific infrastructure project, compared to ‘doing nothing’. Instead of relying on traffic model simulations as the general forecasting and assessment tool in transport planning, we propose to separate the so-called strategic, tactical and operational levels of traffic forecasting into three distinct methodological approaches reflecting the different degrees of openness/closure of the systems at hand: scenario analyses at the strategic level; theory-informed, mainly qualitative analyses supplemented with simple calculations at the tactical level; while more traditional micro-simulations should be applied only at a detailed operational level. In December 1924 when Simone de Beauvoir almost certainly wrote her essay analyzing Claude Bernard's "Introduction to the Study of Experimental Medicine," a classic text in the philosophy of science, she was a 16 yr old student in a senior-level philosophy class at a private Catholic girls' school. Given the popular conception of existentialism as anti science, Beauvoir's early interest in science, reflected in her baccalaureate successes as well as her paper on Bernard, may be surprising. But her enthusiasm for (...) Bernard is unmistakable. We have identified three themes in Beauvoir's essay that reappear in her later work, including the valuing of philosophical doubt. (shrink)

A critical opportunity for identifying children experiencing domestic minor sex trafficking exists in healthcare settings. This quantitative study documented the disconnect between youth seeking help and interventions offered by healthcare providers. Ninety-one sex youth exploited through sex trafficking answered questions detailing their experiences of seeking medical treatment for injuries associated with selling or trading sex. Healthcare providers who were aware that injuries were sustained due to sex trafficking did not always alert legal or mandated reporting authorities. This analysis identified violations (...) of the four pillars of ethical healthcare. This investigation revealed lost opportunities to intervene on behalf of youth suffering trauma and abuse from sex trafficking highlighting the necessity for a formal protocol in healthcare settings to effectively intervene. In recent years the institutionalisation of ethics as a means of enhancing the ethical nature of business operations has received widespread empirical coverage. To date, however, few studies have been conducted in the Australian business context. This paper examines the institutionalisation of ethics by a sample of companies based in Perth, Western Australia. In particular, company representatives were asked if their company was institutionalising ethics, why this initiative was undertaken, how this was taking place and what specific issues were being (...) addressed in the institutionalisation process. The results suggest that perceptions of external parties were the primary motivation for ethics institutionalisation efforts although there was also considerable focus on trying to internalise ethical values. In terms of how ethics were being institutionalised the responding companies were more likely to have conducted ethics training programs than to have written Codes of Conduct and in general it appears that few companies were developing comprehensive formal ethics programs. The primary issue covered by these institutionalisation efforts was the observance of laws. (shrink)

This essay investigates a strand of left-republicanism that emerged in France in the late nineteenth and early twentieth centuries. The solidarists developed a distinctive theory of social property and a thorough critique of the liberal, republican, and socialist alternatives. Solidarism rests on the claim that the modern division of labor creates a social product that does not naturally belong to the individuals who control it as their private property; property, therefore, should be conceived as “common wealth,” divided into individual (...) and public shares. When the wealthy appropriate a disproportionate share, they have a quasi-contractual debt to society that they are obliged to repay. The concepts of social debt, common-wealth, reparations, and rent played an important role in legitimizing egalitarian policies, but they have been largely forgotten today. This article resuscitates the theoretical arguments introduced by the solidarists and explains their relevance for contemporary debates about alternative economic arrangements. (shrink)

A wide range of gene knockout experiments shows that functional stability is an important feature of biological systems. On this backdrop, we present an argument for higher‐level causation based on counterfactual dependence. Furthermore, we sketch a metaphysical picture providing resources to explain the metaphysical nature of functional stability, higher‐level causation, and the relevant notion of levels. Our account aims to clarify the role empirical results and philosophical assumptions should play in debates about reductionism and higher‐level causation. The paper argues that the liberal approach to social rights is contradictory and provides an alternative account that draws on solidarism, a strand of nineteenth-century French Republican thought. Solidarism links together a normative theory of social obligation and a descriptive account of social value, debt and unearned increment. The theory of social property provides a distinctive foundation for social rights.

This paper draws on 'views and visions' responses collected at the time of the Land Use-UK project in 1996. Surveyors were groups of school children with contributions in more remote locations from adults. As well as mapping the landscape participants were asked about their hopes and visions for the grid squares surveyed. One kilometre squares were identified by stratified random sampling techniques from the Ordnance Survey National Grid. The responses indicated varying levels of optimism and pessimism. The sample of responses (...) in this paper relates to rural key squares ( N = 424) and urban key squares ( N = 413). Young surveyors appeared to be the most pessimistic and there was some correlation of increasing pessimism with increasing land use intensity. (shrink)

We argue that Halford et al.'s characterisation of relational complexity offers an unadaptive principle in terms of cognitive economy, that its relation with the empirical evidence is highly selective, and that the task behaviours used in support of a multivector processing space are better described by linear serial processes which do not require n-dimensional mappings for their emergence.

This essay examines one of the contributions that Sandra Bartky makes to feminist theory. Bartky critiques Foucault for his gender blind treatment of the disciplines and social practices that create "docile bodies." She introduces several gender specific disciplines and practices that illustrate that the production of bodies is itself gender coded. This essay argues that social practices are not monolithic, but are composed of various strands that may be in tension with one another.

L'article part du fait qui apparaît de plus en plus clairement dans la psychologie américaine moderne de la personnalité, qu’un certain type de domination de la mère dans la famille exerce une influence fâcheuse sur l’évolution psychique des garçons et des filles. L’auteur étudie les diverses interprétations, qu’on peut donner de ce fait.La première interprétation discutée est celle-ci : pour des raisons biologiques, l’amour naturel serait nécessaire à une évolution saine de l’enfant ; l’égoïsme de la mère exercerait une influence (...) nocive parce qu’elle serait en opposition avec cette nécessité biologique. L’article indique que les rapports naturels de la mère et de l’enfant sont, sous bien des rapports, remplacés par des relations culturelles (en particulier pour l’alimentation), ce qui montre l’incertitude de cette interprétation.La deuxième explication discutée est celle-ci : la tendance à dominer l’enfant, à l’élever en vue de succès conformes aux désirs maternels, serait signe du caractère „névrosé“ de la mère, la nocivité de cette conduite serait imputable à la névrose de la mère. Mais, à l’aide des faits ethnologiques, l’article montre qu’une mère agressive, ambitieuse d’autorité n’exerce pas nécessairement une action nocive sur l’évolution du caractère de l’enfant, mais tout au contraire est susceptible de conduire à l’adaptation la meilleure des enfants aux exigences futures de la société.M. Mead présente une troisième explication possible ; l’influence nocive ne tiendrait pas à la structure du caractère de la mère, mais à la contradiction entre le rôle effectif de la mère dans la famille et son rôle officiel dans la société. En Amérique, la mère a pris effectivement la direction dans la famille, cependant il serait entièrement faux de parler d’un matriarcat, puisque cette domination de fait n’a pas de caractère officiel et n’est pas reconnue par la société. Rien n’a été changé à l’organisation patriarcale de la société américaine, mais les formes patriarcales ont été partiellement privées de leur contenu et sont en contradiction avec les rapports de fait à l’intérieur de la famille. On pourrait dire que la mère exerce son autorité à la manière d’un tyran et non d’un maître légitime. Cette forme de pouvoir maternel non contrôlé par les institutions sociales offre un moyen d’expliquer l’influence nocive de ce pouvoir sur les enfants.Der Aufsatz geht von der in der modernen amerikanischen Persönlichkeitsforschung immer evidenter werdenden Tatsache aus, dass ein gewisser Typ der Vorherrschaft der Mutter in der Familie eine schädliche Wirkung auf die seelische Entwicklung von Knaben und Mädchen hat. Die Verfasserin untersucht, welche verschiedenen Interpretationen für diesen Tatbestand möglich sind.Zunächst wird eine Interpretation besprochen, die davon ausgeht, dass aus biologischen Gründen für die gesunde Entwicklung eines Kindes mütterliche Liebe notwendig ist und dass aus dem Gegensatz zu dieser biologischen Notwendigkeit heraus die egoistische Mutter einen schädlichen Einfluss darstellt. Durch den Hinweis darauf, dass die „natürliche“ Beziehung zwischen Mutter und Kind in vielen anderen Hinsichten durch kulturelle ersetzt werde, speziell in der Ernährung, wird die Fragwürdigkeit dieses Gesichtspunktes begründet.Dann wird die Erklärung diskutiert, nach der die Tendenz, das Kind zu beherrschen und gewaltsam zu im Sinne der Mutter liegenden Erfolgen anzutreiben, ein Symptom des neurotischen Charakters der Mutter und die Schädlichkeit dieses Verhaltens eben in der Neurose der Mutter zu suchen sei. Es wird an ethnologischem Material gezeigt, dass eine aggressive und herrschsüchtige Charakterstruktur der Mutter nicht notwendigerweise schädliche Wirkungen auf die Charakterentwicklung der Kinder hat, sondern ganz im Gegenteil zur optimalen Anpassung der Kinder an die sie später erwartenden gesellschaftlichen Anforderungen führen kann.M. Mead legt eine dritte Erklärungsmöglichkeit vor : dass der schädliche Einfluss nicht in der Charakterstruktur der Mutter an sich zu suchen ist, sondern in dem Widerspruch zwischen der faktischen Rolle der Mutter in der Familie und ihrer „offiziellen“ Rolle in der Gesellschaft. Während die amerikanische Mutter häufig tatsächlich die Herrschaft in der Familie an sich gerissen hat, wäre es doch ganz falsch, von einem Matriarchat in Amerika zu sprechen, da die faktische Herrschaft in der Familie in keiner Weise den Charakter einer offiziellen und gesellschaftlich anerkannten Herrschaft der Frau angenommen hat. Vielmehr hat sich an der patriarchalischen Organisation der amerikanischen Gesellschaft nichts Entscheidendes geändert, aber die patriarchalischen Formen sind zum Teil ihres Inhaltes beraubt worden und stehen im Gegensatz zu den faktischen Verhältnissen in der Familie. Die Mutter übt ihre Herrschaft gleichsam nicht als ein rechtmässiger Herrscher, sondern als ein Tyrann aus. In dieser durch gesellschaftliche Institutionen nicht kontrollierten Form mütterlicher Herrschaft wird eine Erklärungsmöglichkeit für den schädlichen Einfluss dieser Herrschaft auf die Kinder gesehen. This article presents results from a self-report survey of misconduct behaviours and the stress students (n = 916) experienced at one Canadian community college. Results showed that students engaged in a variety of contract cheating behaviours, and experienced a myriad of stressors both in and outside the college context, including traumatic life events. Those who engaged in commercial contract cheating and inappropriate sharing behaviours experienced significantly higher levels of stress. This result differed by type of stress suggesting that not all (...) stress may lead to violation behaviour. Results also suggest that some students are exposed to more stress than others, which could put them at higher risk for engaging in contract cheating. Understanding contract cheating using the stress process framework draws our attention to how a student’s location in the social institutions of work, family, and school, how their positions of advantage or disadvantage, and their involvement in social relationships may produce stress which we have found to be associated with contract cheating. Seeing stress in this way allows post-secondary institutions to address the structural conditions which lead to stress through the development of policy, procedure, and supports for students as they navigate academic integrity throughout their programs. <b>Objectives:</b> To gather empirical data on how gender and educational level influence bioethical reasoning among medical students by analyzing their use of care versus justice arguments for reconciling a bioethical dilemma. <b>Setting:</b> University Departments of Medical Ethics, Social and Communication Psychology in Germany. Participants: First and fifth year medical students. Design and method: Multidisciplinary, empirical, 2-segment study of ethics in action: In intrapersonal Segment 1, the students were presented with a bioethical dilemma and then administered a 13-item questionnaire to survey (...) their individual preferences for care versus justice arguments in resolving the conflict. The survey questioned 6 justice, 6 care-related items and 1 socially critical item. Data were analysed by gender and year of medical school. In interpersonal Segment 2, the bioethical dilemma from Segment 1 was discussed in gender-mixed and gender-homogeneous groups. Coded transcripts were evaluated to identify prevalences in care versus justice reasoning. <b>Results:</b> Data on 462 medical students were evaluable (n=338 in Segment 1, n=168 in Segment 2, n=44 overlap). Gender and level of education had no effect on moral reasoning in intrapersonal Segment 1, but significantly affected reasoning in interpersonal Segment 2, where women significantly tended to use more care-orientated arguments. Justice arguments predominated the group discussions. <b>Conclusion:</b> Interpersonal contexts affect moral reasoning in medical students, probably by amplifying the socialisation relating to gender and educational level. Care orientation is associated with the female gender. Professional socialisation tends to reduce the diversity and richness of moral reasoning towards a more justice-weighted orientation. Medical ethics should teach both justice and care reasoning modes in order to broaden physicians' ability to reconcile bioethical dilemmas. (shrink)

ObjectiveTo examine the effect of family and perceived organizational support on the relationship between nurse adaptability and their experience with COVID-related PTSD (post-traumatic stress disorder) symptoms in frontline nurses working on COVID-19 units.BackgroundProximity to and survival of life-threatening events contribute to a diagnosis of PTSD, which is characterized by avoidance of reminders of trauma, intrusive thoughts, flashbacks of events, sleep disturbances, and hypervigilance. Using the job-demands and resource model, we examined the effect of adaptability, family support, and perceived organizational support (...) on PTSD symptoms for nurses during the COVID-19 pandemic. Specifically, we tested whether perceptions of environmental supports—i.e., family and organizational support—moderated the relationship between nurse adaptability and COVID-related PTSD symptoms.MethodsA sample of frontline nurses working on COVID-19 units during the COVID-19 pandemic in Texas (N= 277) participated in this cross-sectional, observational study. Frontline Nurses reported demographic information and completed surveys designed to measure adaptability, perceived organizational support, family support, and COVID-related PTSD symptoms.ResultsAdaptability was significantly positively correlated (medium effects) to perceived organizational and family support (r= 0.51 and 0.56, respectively,p< 0.01). Adaptability and perceived organizational support were also negatively correlated with COVID-related PTSD symptoms (medium effects). Adaptability was negatively correlated with COVID-related PTSD symptoms, supporting Hypothesis 1 (r= −0.43,p< 0.01). Perceived organizational support was also significantly negatively correlated with COVID-19-related PTSD symptoms (r= −0.30,p< 0.01). Family support was not significantly correlated with COVID-related PTSD but was positively related to experiencing COVID-related PTSD after other variables were accounted for.ConclusionFindings suggest that individual adaptability and organizational support may reduce PTSD severity in frontline nurses working during a crisis; however, family support may increase PTSD symptoms. We provide suggestions for strengthening individual adaptability and healthcare leadership including remaining highly engaged to show support by providing rapid communication, remaining calm during difficult circumstances, and maintaining a consistent, physical presence during difficult times. Moreover, our results suggest additional support for nurses with families to adapt to crisis. (shrink)
